1. About Our Services

1.1 Ashleigh Gale is an Accredited Practising Dietitian (APD) credentialled by Dietitians Australia. Our Services include nutrition consultations, body composition assessments (including DEXA scan coordination), personalised nutrition planning, supplement reviews, and associated reporting and support.

1.2 Our Services address nutrition, dietary intake, and body composition and may support the management of medically diagnosed conditions. They do not constitute medical diagnosis, medical treatment, or a replacement for care provided by a general practitioner or specialist.

1.3 Clients with existing health conditions are encouraged to maintain an ongoing relationship with their treating medical team. Where a medical condition exists or is suspected, you should consult your GP or relevant specialist before commencing our Services.

1.4 Ashleigh Gale is not a medical practitioner and cannot diagnose medical conditions or prescribe medications.

2. Telehealth Services

2.1 Our Services are delivered via telehealth (online video consultation). By engaging our Services, you acknowledge and agree that:

• (a) Telehealth consultations are conducted remotely and may not be appropriate for all clinical situations. Where in-person assessment is required, we will advise you accordingly.
• (b) The quality of telehealth consultations may be affected by factors outside our control, including internet connectivity, platform availability, and technical issues. We are not liable for any disruption, delay, or loss of service arising from such factors.
• (c) While we take all reasonable steps to protect your privacy during telehealth consultations, online communication platforms carry an inherent risk of interception or unauthorised access. By participating in telehealth consultations, you accept this risk.
• (d) Telehealth consultations are not a substitute for emergency medical care. If you are experiencing a medical emergency, please contact emergency services on 000.

2.2 We use third-party platforms to deliver telehealth services. Your use of those platforms is subject to the terms and privacy policies of those providers.

3. Bookings and Payment

3.1 All Services must be paid for in full at the time of booking unless otherwise agreed in writing.

3.2 All prices are in Australian dollars (AUD) and are inclusive of GST where applicable.

3.3 Payment is processed securely through our third-party payment provider, Stripe. We do not store your full credit card details.

3.4 By completing a purchase, you warrant that you are authorised to use the payment method provided.

4. Refund and Cancellation Policy

4.1 Third-party testing costs (including DEXA body composition scans) are non-refundable once a scan appointment has been booked, regardless of the reason for cancellation. This is because those costs are incurred directly with our imaging partners and cannot be recovered.

4.2 For the consultation and reporting component of our Services:

• (a) A full refund of the consultation fee is available if you cancel more than 48 hours before your scheduled consultation.
• (b) Cancellations made within 48 hours of the scheduled consultation will forfeit the consultation fee.
• (c) No refund is available once a consultation has been delivered.

4.3 For multi-session or package services (including the Performance Baseline + Progress and any Sustained programs):

• (a) The third-party testing component is non-refundable once any scan has been booked, as set out in clause 4.1.
• (b) For the remaining program components not yet delivered, a partial refund may be available at our discretion where cancellation is requested in writing and a reasonable basis for cancellation is provided.
• (c) No refund is available for program components already delivered.

4.4 Change of mind is not grounds for a refund under these Terms or under the Australian Consumer Law where services have already been partially or fully delivered.

4.5 Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

4.6 To request a cancellation or refund, please contact us in writing at hello@ashleighgale-dietitian.com.

5. Rescheduling

5.1 You may reschedule a consultation by providing at least 24 hours notice. Requests to reschedule with less than 24 hours notice may be treated as a cancellation and subject to clause 4.2(b).

5.2 We will make reasonable efforts to accommodate rescheduling requests, subject to availability.

6. Your Responsibilities

6.1 You agree to:

• (a) provide accurate, complete, and up-to-date information when completing intake forms, questionnaires, and booking forms;
• (b) disclose all relevant health information, medications, supplements, and medical history that may affect the Services we provide;
• (c) inform us of any changes to your health status during the course of our Services;
• (d) follow up with your GP or treating specialist where recommended by us;
• (e) use the Website and Services for lawful purposes only.

6.2 You acknowledge that the quality and appropriateness of our Services depends on the accuracy and completeness of the information you provide. We are not liable for any outcomes arising from inaccurate or incomplete information provided by you.

7. Intellectual Property

7.1 All content on the Website, including but not limited to text, graphics, logos, program names, program frameworks, methodologies, written materials, and session summaries prepared for you, is the intellectual property of Ashleigh Gale Dietitian unless otherwise stated.

7.2 Our program names and methodologies including The Performance Baseline, The Body Baseline, The Strong + Sustain Method, Sustained: The Weight Loss Method, and Sustained: The Medical Weight Loss Method are proprietary to Ashleigh Gale Dietitian. Unauthorised use, reproduction, or imitation of these names or methodologies is prohibited.

7.3 You may not reproduce, distribute, modify, or publish any content from the Website or our Services without our prior written consent.

7.4 Session summaries, nutrition plans, and other documents we prepare for you are provided for your personal use only and may not be shared commercially or distributed without our written consent.

8. Disclaimer of Warranties

8.1 Our Services are provided in good faith and based on information provided by you. Individual outcomes from nutrition and dietetic services vary and we do not guarantee specific results.

8.2 The Website and its content are provided for general information purposes. While we take care to ensure information is accurate and up-to-date, we make no warranty as to its completeness, accuracy, or suitability for any particular purpose.

8.3 Nothing on the Website constitutes medical advice. You should always seek advice from a qualified medical practitioner for medical concerns.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, Ashleigh Gale Dietitian will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of our Services or Website, including but not limited to loss of income, loss of data, or personal injury.

9.2 Where liability cannot be excluded under the Australian Consumer Law, our liability is limited to resupply of the relevant service or payment of the cost of having the service resupplied.

9.3 Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot be excluded.

10. Third Party Services

10.1 Our Services involve coordination with third-party providers including diagnostic imaging services for DEXA scans. Your interaction with those providers, including your attendance at scan appointments, is subject to their own terms and policies.

10.2 We are not responsible for the acts or omissions of third-party providers, including any errors in scan results or delays in appointments.

10.3 The Website may contain links to third-party websites. We do not endorse or take responsibility for the content of those websites.

11. Privacy

11.1 We collect and handle your personal information in accordance with our Privacy Policy, available at www.ashleighgale-dietitian.com/privacy-policy.

11.2 By engaging our Services, you consent to the collection and use of your personal information as set out in our Privacy Policy.

12. Changes to These Terms

12.1 We may update these Terms of Use from time to time. Changes will be posted to the Website and will take effect immediately upon posting.

12.2 Your continued use of the Website or Services following any changes constitutes your acceptance of the updated Terms.
